Amsterdam House seeks further extension of exclusive plan periods

Olympia, Wash., Oct. 4 – Amsterdam House Continuing Care Retirement Community, Inc., which does business as the Harborside, is seeking another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Tuesday with the U.S. Bankruptcy Court for the Eastern District of New York.

Specifically, the company asked the court to extend the exclusive plan filing period through Nov. 17 from Oct. 3 and the exclusive solicitation period through Jan. 16 from Dec. 2.

The company said the debtor and its advisers have continued to devote significant time to the debtor’s sale process, which has involved, among other things, extensive engagement with interested purchasers, preparation for and attendance at a multi-day auction and mediation process, both of which remain ongoing.

“The size and complexities of this Chapter 11 case warrant a further extension of the exclusive periods to provide the debtor with time necessary to formulate and negotiate a plan with key case constituents,” the company said in the motion.

The Port Washington, N.Y.-based retirement community builder and operator filed Chapter 11 bankruptcy for the third time on March 22, 2023 under Chapter 11 case number 23-70989.
