Foamex seeks 30-day extension to exclusive plan vote solicitation period

By Caroline Salls

Pittsburgh, Jan. 16 - Foamex International Inc. requested an extension to its exclusive period to solicit votes on its plan of reorganization, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The company wants to extend its exclusive solicitation period by 30 days to Feb. 14 from Jan. 15.

Foamex filed its plan and obtained court approval of the related disclosure statement on Nov. 27. The plan confirmation hearing is scheduled for Feb. 1.

Although the company said it expects the plan to be approved by creditors and to be confirmed following the Feb. 1 hearing, Foamex said it is seeking the extension to maintain exclusivity through the completion of the confirmation process.

Foamex, a Linwood, Pa., manufacturer and distributor of flexible polyurethane and advanced polymer foam products, filed for Chapter 11 on Sept. 19, 2005. Its case number is 05-12685.
