Whittaker seeks another extension of exclusive plan periods

Olympia, Wash., April 24 – Whittaker, Clark & Daniels, Inc. has asked for another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Wednesday with the U.S. District Court for the District of New Jersey.

The company asked the court to extend the exclusive plan filing period through Oct. 28 from May 20 and the exclusive solicitation period through Dec. 26 from July 22.

“The debtors have spent months responding to and litigating the motion to dismiss (and related appeals), the adversary proceeding, and a massive list of discovery requests while concurrently engaging in mediation and settlement negotiations in an attempt to reach a consensual global resolution of these Chapter 11 cases,” the company said in the motion.

“It is now clear that the debtors need the full statutory extension of the exclusivity extension periods.”

A hearing is scheduled for May 15.

Whittaker, Clark & Daniels is a talc supplier based in Stamford, Conn. The company filed Chapter 11 bankruptcy on April 26, 2023 under case number 23-13575.
