Whittaker receives another extension of exclusive plan periods

Olympia, Wash., Nov. 3 – Whittaker, Clark & Daniels, Inc. received another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Friday with the U.S. District Court for the District of New Jersey.

The court extended the exclusive plan filing period through Feb. 20 and the exclusive solicitation period through April 22.

The company had asked for a longer extension, with the exclusive filing period ending March 21 and the exclusive solicitation period ending May 21.

Whittaker said that it has spent the last six months transitioning into Chapter 11, responding to and litigating the motions to dismiss and the Orange County Water District’s motion to vacate the automatic stay, and positioning the debtors to engage in global settlement negotiations.

In addition, the debtors are continuing to actively respond to discovery requests from the committee.

“While the debtors are hopeful that the committee will eventually commit to reaching a workable resolution for the benefit of present and future claimants, given the complexity of the issues presented by these Chapter 11 cases and the competing interests among the parties, consensus on the terms of a Chapter 11 plan will take additional time,” the company said in its motion seeking the extension.

Whittaker, Clark & Daniels is a talc supplier based in Stamford, Conn. The company filed Chapter 11 bankruptcy on April 26, 2023 under case number 23-13575.
