Ryze Renewables secures another extension of exclusive plan periods

Olympia, Wash., Nov. 28 – Ryze Renewables II, LLC received another extension of its exclusive periods to file a Chapter 11 plan and solicit acceptances, according to an order filed Monday with the U.S. Bankruptcy Court for the District of Delaware.

The court extended the periods by 90 days, with the exclusive plan filing period extended through Feb. 5 from Nov. 6, and the exclusive solicitation period extended through April 2 from Jan. 3.

The company has filed a Chapter 11 plan and disclosure statement, as previously reported.

Ryze said it sought the extension out of an abundance of caution as it works toward confirmation of the plan, which is expected for Jan. 8.

“The debtors believe that maintaining their exclusive right to file and solicit votes on a Chapter 11 plan for a reasonable period of time is essential to their ability to orderly wind down their estates without risking the additional costs, disruption and uncertainty that could arise from the expiration of the exclusive periods,” the company said in the motion.

The Las Vegas-based renewable fuel producer filed bankruptcy on March 9, 2023 under Chapter 11 case number 23-10289.
