Former Christian Care: U.S. trustee objects to Chapter 11 plan

Olympia, Wash., Jan. 18 – The Chapter 11 plan of CCC Wind Down, Inc., formerly known as Christian Care Communities & Services, drew an objection from Region 6 U.S. trustee William T. Neary, according to documents filed Tuesday with the U.S. Bankruptcy Court for the Northern District of Texas.

The sale closed on Dec. 1, the company said Thursday.

Neary said he objects to the plan because it impermissibly exculpates the plan administrator and the debtors’, committee’s and plan administrator’s professionals.

The U.S. trustee said the confirmation order should also clarify that no governmental or regulatory claims are released.

The combined hearing on confirmation of the plan and final approval of the disclosure statement is scheduled for Jan. 30.

The Texas-based non-profit faith-based organization operates three communities for seniors in Mesquite, Fort Worth and Allen. The company filed bankruptcy on May 23, 2022 under Chapter 11 case number 22-80000.
