Wireless Systems Solutions seeks extension of exclusive plan periods

Olympia, Wash., July 1 – Wireless Systems Solutions, LLC is seeking an extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Thursday with the U.S. Bankruptcy Court for the Eastern District of North Carolina.

Specifically, the company asked the court to extend the plan filing period through Aug. 6 from July 7 and the solicitation period through Oct. 5 from Sept 5.

On May 10, the court entered an order appointing an examiner in the case to evaluate whether the debtor’s post-petition work violates an injunction in favor of SmartSky Networks, LLC, entered in an arbitration proceeding and confirmed by an order from the U.S. District Court for the Middle District of North Carolina.

The deadline for the examiner to complete his report is July 11.

The company said waiting for the completion of the examiner’s report will allow the debtor to better evaluate its ongoing and future business prospects, project its income, and determine the appropriate plan payments.

A hearing is scheduled for July 6.

The Morrisville, N.C.-based cellular network solutions company filed Chapter 11 bankruptcy on March 9 under case number 22-00513.
