Red River Waste creditors committee opposes exclusivity extension

Olympia, Wash., Feb. 7 – Red River Waste Solutions, LP’s motion seeking an extension of its exclusive periods to file and solicit votes on a Chapter 11 plan drew opposition from the official committee of unsecured creditors, according to court documents filed Friday with the U.S. Bankruptcy Court for the Northern District of Texas.

As previously reported, the company asked the court to extend the plan filing period through June 13 from Feb. 11 and the solicitation period through Aug. 10 from April 12.

One of the company’s largest customers, Nashville and Davidson County, filed an objection to the exclusivity extension motion, and the committee filed a joinder to the objection shortly after.

“Nashville believes that this court must be advised that the debtor’s rosy picture of its progress is not accurate and that at this point in time Nashville – being a significant revenue source of the debtor’s business – has grave concerns about the ability of the debtor or its yet unnamed assignee to cure the ongoing defaults in its contract and provide adequate assurance of future performance,” Nashville said in its objection.

The city said the court should exercise its discretion under the circumstances to keep the time pressure on the debtor to quickly resolve the uncertainty regarding the outcome of the bankruptcy case and its contract with Nashville.

A hearing is scheduled for Feb. 9.

The Dripping Springs, Tex.-based waste management company filed bankruptcy on Oct. 14 under Chapter 11 case number 21-42423.
