WL Homes: FC Stapleton seeks to compel Chapter 7 trustee to complete 2009 property sale

Charlotte, N.C., Sept. 7 - WL Homes, LLC would-be asset buyer FC Stapleton II, LLC asked the court to compel Chapter 7 trustee George L. Miller to comply with an order in which a property sale was to close by the end of September 2009, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.

Miller, the filing said, "has demonstrated little interest in closing the transaction" and specifically in the past 24 months has not "provided any meaningful cooperation in facilitating the removal of encumbrances from the real property transferred pursuant to the sale order."

A hearing is set for Sept. 28.

WL Homes, an Irvine, Calif.-based homebuilder, filed for bankruptcy on Feb. 19, 2009. Its Chapter 11 case number is 09-10571.
