Phoenix Services wins another extension of exclusive plan periods

By Sarah Lizee

Olympia, Wash., May 8 – Phoenix Services LLC secured another extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to an order filed Monday with the U.S. Bankruptcy Court for the District of Delaware.

Specifically, the court extended the exclusive plan filing period through July 24 and the exclusive solicitation period through Sept. 25.

The debtor said in its motion seeking the second extension that it has made significant progress since it received its first exclusivity extension, including filing a plan and disclosure statement.

The company said it requested a further extension so it can prosecute the plan and, if needed, continue to negotiate with all parties in interest to reach a resolution of its case.

Radnor, Pa.-based Phoenix Services is a provider of outsourced slag handling, metal reclamation and complementary services to steel mill customers. The company filed bankruptcy on Sept. 27 under Chapter 11 case number 22-10906.
