Washington Mutual and WMI Investment appeal claim prosecution ruling

By Caroline Salls

Pittsburgh, Oct. 11 - Washington Mutual, Inc. and WMI Investment Corp. have appealed a court order granting the company's official committee of equity security holders standing to prosecute equitable subordination claims, according to a Tuesday filing with the U.S. Bankruptcy Court for the District of Delaware.

In the Sept. 13 order, judge Mary F. Walrath denied confirmation of Washington Mutual's modified plan of reorganization and gave the shareholder group approval to prosecute the claims.

Washington Mutual, a Seattle-based savings and loan holding company, filed for Chapter 11 bankruptcy on Sept. 26, 2008. Its Chapter 11 case number is 08-12229.
