Perkins & Marie eyes exclusivity extension to further plan progress

Pittsburgh, Oct. 11 - Perkins & Marie Callender's Inc. requested an extension to its exclusive periods for filing and soliciting votes on a plan of reorganization, according to a Monday filing with the U.S. Bankruptcy Court for the District of Delaware.
The company said it wants to extend its exclusive filing period to Jan. 9 from Oct. 11 and the solicitation period to March 12 from Dec. 12.
As previously reported, the disclosure statement for Perkins & Marie's second amended plan was approved in September. The company said the plan voting deadline is 4 p.m. ET on Friday, and the confirmation hearing is scheduled for Oct. 31.
According to the motion, Perkins & Marie is soliciting plan votes, reconciling claims, working with restructuring support parties to prepare the plan supplement, preparing a schedule of rejected contracts and leases and determining cure amounts for the executory contracts and unexpired leases that will be assumed.
The company said in the filing that the requested extension will allow it to make additional progress toward plan confirmation.
A hearing is scheduled for Oct. 31.
Perkins & Marie Callender's, a Memphis-based operator and franchiser of full-service restaurants, filed for bankruptcy on June 13. The Chapter 11 case number is 11-11795.
