Energy Future disclosure hearing Aug. 29; plan hearing begins Oct. 24

Pittsburgh, July 28 – Energy Future Holdings Corp.’s disclosure statement approval hearing has been postponed to Aug. 29 from Aug. 11, according to an order filed Friday with the U.S. Bankruptcy Court for the District of Delaware.

Objections to the disclosure statement must be filed by 4 p.m. ET on Aug. 18, and the company must file any replies by 4 p.m. ET on Aug. 24.

The final disclosure statement approved by the court must be filed by Aug. 31.

According to the order, the plan of reorganization confirmation hearing will begin on Oct. 24 and will continue each day from Oct. 25 to Nov. 2, as necessary.

In Friday’s order, judge Christopher S. Sontchi said he “strongly encourages the parties to resolve all objections to the disclosure statement before the disclosure statement hearing.”

Sontchi also said he “strongly discourages the parties from pursuing expensive, time-consuming and unnecessary discovery or litigation regarding the adequacy of the disclosure statement or confirmation of the plan.”

Energy Future is a Dallas-based power generation company and utility operator. The company filed for bankruptcy on April 29, 2014. The Chapter 11 case number is 14-10979.
