Energy Future plan disclosure hearing pushed back a month to Aug. 18

New York, July 2 – Energy Future Holdings Corp.’s hearing to consider approval of the disclosure statement related to its Chapter 11 plan of reorganization has been continued to Aug. 18, according to a scheduling order filed Thursday with the U.S. Bankruptcy Court for the District of Delaware.

Under a previous scheduling order the hearing was set to begin July 20, and the court encouraged the debtors to resolve any objections to the disclosure statement prior to the hearing.

Mediation was ordered to begin by May 18 and end by July 20 with Peter L. Borowitz acting as mediator.

The mediation is supposed to cover the terms of the plan related to the restructuring of the TCEH debtors’ estates and the treatment of claims held by the mediation parties against the TCEH debtors’ estates.

The TCEH debtors include Energy Future Competitive Holdings Co., LLC and Texas Competitive Electric Holdings Co., LLC, as well as their subsidiaries.

As previously reported, Energy Future filed a joint reorganization plan and related disclosure statement in mid-April that called for a merger and equity investment or a stand-alone reorganization of the company.

The new scheduling order also set July 23 as the deadline for Energy Future to file an amended disclosure statement, and Aug. 6 will be the last day parties can formally object to the disclosure.

Any discovery being conducted related to the plan must be completed by Dec. 18 and a final pre-confirmation trial conference will be held on Jan. 19, 2016.

The confirmation hearing is scheduled to begin on Jan. 20, 2016 and may continue through March 2, 2016 if need be.

Energy Future, a Dallas-based power generation company and utility operator, filed bankruptcy on April 29, 2014. The Chapter 11 case number is 14-10979.
