Former Chem Rx gets additional time file plan; exclusivity terminated

By Lisa Kerner

Charlotte, N.C., Nov. 24 - CRC Parent Corp.'s request for an extension to its exclusive periods to file a plan of reorganization and solicit votes on the plan was granted, according to a Wednesday filing with the U.S. Bankruptcy Court for the District of Delaware.

The court extended the former Chem Rx Corp.'s exclusive filing period to Jan. 9 from Nov. 9 and the solicitation period through Feb. 28.

CRC's exclusivity under section 1121 of the Bankruptcy Code was terminated solely to allow the committee and first lien lenders to jointly file and solicit acceptances of a Chapter 11 plan, the filing said.

Chem Rx, a Long Beach, N.Y.-based provider of institutional pharmacy services, filed for bankruptcy on May 11. Its Chapter 11 case number is 10-11567.
