API Americas eyes 90-day exclusivity extension following plan filing

Pittsburgh, May 20 – API Americas Inc. is asking the U.S. Bankruptcy Court for the District of Delaware to extend its exclusive periods for filing a Chapter 11 plan and soliciting votes on that plan, according to a motion filed Tuesday.

If approved, API’s exclusive plan-filing period would be extended by 90 days through Sept. 1 and the solicitation period through Oct. 29.

As previously reported, the company filed a plan of liquidation on May 7. A hearing on the plan voting procedures is scheduled for May 28.

“To ensure that these Chapter 11 cases continue to progress in an effective and efficient manner while the debtors seek confirmation of the plan, the debtors seek the requested extensions,” the motion said.

A hearing is scheduled for June 29.

API is a Lawrence, Kan.-based foils and laminates manufacturer. The company filed bankruptcy on Feb. 2 under Chapter 11 case number 20-10239.
