Associated Wholesalers eyes further 75-day extension of plan periods

New York, March 4 – Associated Wholesalers, Inc. is seeking a second extension of its exclusive Chapter 11 plan filing and solicitation periods, according to a March 4 motion with the U.S. Bankruptcy Court for the District of Delaware.

The company asked that its plan filing period be extended through May 26 from March 9 and its solicitation period through July 21 from May 7.

Associated said it has “devoted considerable time and resources in recent months” to resolving issues with pensioners, vendor and its asset purchaser, withdrawal liability and employee benefit problems, and to addressing the “many claims” that have been filed in the case, according to the motion.

As “neither the debtors' creditors nor any other party in interest will be prejudiced by the proposed extension,” the company said the extension will allow it to “maintain the status quo in these Chapter 11 cases while negotiating a consensual plan of liquidation” and continue liquidating any remaining assets.

A hearing to consider the extension is set for April 30.

Associated Wholesalers is a cooperative food distributor and equipment retailer based in Robesonia, Pa., that filed for bankruptcy on Sept. 9. The Chapter 11 case number is 14-12092.
