ASHINC requests U.S. trustee appoint death benefits retiree committee

Bethlehem, Pa., Oct. 5 – ASHINC Corp., formerly Allied Systems Holdings, Inc., requested court approval to direct the U.S. trustee to appoint an official death benefits retiree committee, according to a motion filed Friday with the U.S. Bankruptcy Court for the District of Delaware.
The death benefits retiree committee will serve as the authorized representative of the death benefits retirees.
The company is requesting the formation of the committee as the existing committee has declined to take on such responsibility.
“Although the existing retiree committee is the authorized representative for purposes of section 1114 for those retirees receiving the medical benefits, it has not agreed to represent the nearly 145 retirees receiving the death benefits,” the motion said. “Accordingly, in order to allow the debtors to comply with its obligations under section 1114 with respect to its request to modify the death benefits and to allow the October hearing on plan confirmation to proceed as planned, the formation of the death benefits retiree committee on an ex parte basis is necessary at this time.”
Allied Systems is a Decatur, Ga.-based distributor of new and used vehicles. The company filed for bankruptcy on June 11, 2012 under Chapter 11 case number 12-11564.
