Allegiance Telecom Liquidating Trust to get $7.96 million from XO in receivables and fee dispute ruling

By Caroline Salls

Pittsburgh, Jan. 5 - Allegiance Telecom Liquidating Trust will receive a $7.96 million payment with interest from XO Holdings, Inc. under a ruling by the U.S. Bankruptcy Court for the Southern District of New York on account of receivables and management fee disputes, according to an 8-K filing with the Securities and Exchange Commission.

The order also requires Allegiance to pay XO $2.82 million with interest on account of a disputed liabilities true-up dispute.

According to the 8-K, XO filed a motion on Dec. 22 seeking to amend or clarify the payment order.

Dallas-based Allegiance, which was a facilities-based local exchange carrier, filed for bankruptcy on May 14, 2003, and XO acquired the company in June 2004. Allegiance's Chapter 11 case number is 03-13057.
