Washington Mutual examiner wants more time to file final report

Pittsburgh, Sept. 7 - Washington Mutual, Inc.'s court-appointed examiner is asking the U.S. Bankruptcy Court for the District of Delaware for more time to file the final report of his investigation of the company's global settlement, according to a Tuesday court filing.

Examiner Joshua R. Hochberg said he is currently required to file his report by Oct. 8 unless additional discovery time is required.

Hochberg said a "significant number" of documents must still be obtained from JPMorgan Chase Bank, government agencies and third parties, and those documents must be reviewed and analyzed.

In addition, the examiner said witnesses are scheduled to be interviewed through Sept. 17, and more interviews are being arranged.

"Based upon the current schedule for interviews, the need for additional and follow up interviews, the number of documents reviewed to date, the number of outstanding document requests and the need to analyze and evaluate all such information to complete the final report, the examiner believes he will need an extension of time," Hochberg said.

Under his proposed revised schedule, the examiner would deliver excerpts of the final report on Oct. 25 to all parties, which will discuss confidential information obtained from that party but not include any of the examiner's conclusions.

The examiner will meet with each party to resolve any objections by Oct. 27, and he will reveal his findings to each party by Oct. 28.

A redacted version of the final report would be filed on Nov. 1, and an unredacted version would be filed under seal.

Washington Mutual, a Seattle-based savings and loan holding company, filed for Chapter 11 bankruptcy on Sept. 26, 2008. Its Chapter 11 case number is 08-12229.
