Endo International seeks 90-day extension of exclusive plan periods
By Sarah Lizee
Olympia, Wash., Oct. 11 – Endo International plc is seeking a 90-day extension of its exclusive periods to file and solicit votes on a Chapter 11 plan, according to a motion filed Tuesday with the U.S. Bankruptcy Court for the Southern District of New York.
The extension would push back the exclusive plan filing period through Jan. 8 and the exclusive solicitation period through March 8.
The company said the debtors need additional time to continue their mediation to aid in reaching key resolutions with objecting parties.
Endo said this will clear the path to a successful and value-maximizing conclusion to the Chapter 11 cases.
The company noted that its sale hearing has been adjourned with the agreement and support of key stakeholders.
“Such adjournments are not an indication that progress has stopped but the opposite,” Endo said in the motion.
“The debtors continue to push toward consensus and are confident more progress can be made.”
The company said that in light of the size and complexity of the Chapter 11 cases and the additional time needed to allow the debtors to continue the mediation and push the cases to a value-maximizing conclusion, the exclusive periods should be extended.
Endo is a Dublin, Ireland-based specialty pharmaceutical company that filed bankruptcy on Aug. 16, 2022. The Chapter 11 case number is 22-22549.
