Drug Fair committee seeks venue change to New Jersey

Pittsburgh, March 31 - Drug Fair Group, Inc.'s official committee of unsecured creditors asked the U.S. Bankruptcy Court for the District of Delaware to transfer the company's bankruptcy case to the U.S. Bankruptcy Court for the District of New Jersey, according to a Tuesday filing.

Despite incorporation in the state of Delaware, the committee said 100% of the company's business operations are located in New Jersey, as are all but two of the committee members and more than half of Drug Fair's creditors.

In addition, the committee said two of the company's unsecured creditors were prepared to file an involuntary bankruptcy case against Drug Fair in the New Jersey court, but the company beat them to it by making the voluntary filing in Delaware just two hours sooner.

Drug Fair, a Somerset, N.J.-based operator of pharmacies and general merchandise stores, filed for bankruptcy on March 18. Its Chapter 11 case number is 09-10897.
