Bestwall, asbestos claims parties agree to mediation on plan terms
By Caroline Salls
Pittsburgh, Dec. 19 – Bestwall LLC, its official committee of asbestos personal injury claimants, future asbestos injury claimants representative Sander L. Esserman and Bestwall non-debtor affiliate Georgia-Pacific LLC have agreed to participate in mediation in an effort to develop the primary terms of a consensual Chapter 11 plan, according to an order filed Wednesday with the U.S. Bankruptcy Court for the Western District of North Carolina.
Richard J. Davis of Richard J. Davis Law will serve as the mediator.
If the issue is not resolved through mediation, a rehearing on asbestos claims estimation will be scheduled.
In addition, if the mediation is not concluded by Feb. 20, the parties must participate in a status conference on that date on the progress and plans for conclusion of the mediation.
Davis was ordered to file a report within 10 days of the conclusion of the mediation.
Bestwall, an affiliate of Atlanta-based pulp and paper company Georgia Pacific, filed for bankruptcy on Nov. 2, 2017. Bestwall’s Chapter 11 case number is 17-31795.
